sallie mae student loans-in default and i asked for TPD forgiveness

i can not work and have had my loans in forebarences for a few years and now they will not renew my forebarences abut may give me aneconomic hardships b/c i get only 640 a month from ssdi.
 
they sent me the forms to fill out and give to my doc and he filled them out but sallie mae says it could take up to a year b/c the forgive any if at all loans.
 
after 30 days they can attach your home and bank accounts and even garnish 10-15% of your ssdi income and take your taxe return.
 
waht do i do, i sent by epxress mail the doc form and everytime i call on the phone i get a rep who frustrated me by not listsening to waht i am saying or doing, they ignore me.
 
they sento on of the forms back to my doctor saying hte dates were incorrect and i wenttosee him to tofay for tw oshots and have him re-fill out the form and then mailed express mail, these people scare me, they ahve more pwoer than the irs and child support services. i am square with the irs as i didnt make any morey to declare,
the child support thingi s over with i met my obligation for my son and am done with him legally.
 
but i have a hosue and i do not want it attached so maybe i should put it in my sons name and take it out of my name

Seems you need an attorney... somebody these people will not ignore!  You need some legal advice about changing the title to your home, too.  If you put the house in somebody else's name in an effort to salvage it, then they can get you even worse for attempting to defraud ... be careful.

not too sure about that one, in florida it is one state in the union that peeps can be freed up from homestead exemtpion many docs do this and business men also ( ken lay put his assets in in wifes name but he died anyways and now they cant touch him he had a house a fancy one at that  in ft lauderdale)
 
so maybe i can do this i am just looking for a legal way out of this b/c i cant pay back that money and they will take out 10-15% of my ssdi pay, i legally have the right to ask for student loan forgiveness b/c i am considered totally permanently disabiled but they do not go by the same standards as ssA does nor can you protest their decision like you can with ssa.
 
so they are like the police who make their own rules. only way you can get outta paying them is if you die but they can put leins on everything you own before you die and so therefore can attach anything you own before you croak....

Missie HI,

My only Brother had loans as well through the same people and he got in a tight squiz (sp) and they threaten him and he put his truck in my dad's name and he also put his money in my dad's bank account to keep them from doing the very same thing they are trying to do to you.i'am not telling you that this is what you need to do but I did want to pass this on to you.Olease let me know how it goes.

umh....i was under the impression that if you were claimed disabled, student loans were forgiven?

well, i really know nothing about any of this, but personally....for credit collectors & debts for school i owe, i send anything i have. even if it's 5 dollars. anything. that way, it's documented you are attempting to pay. i make sure they know i have a disability pending.
but that's it. if i have nothing? i can't send it. but communication is good. and even a few dollars sent is taken.
what about contacting the disability counselor for your county? was this for school? or a personal loan?
Active/Severe Rheumatory Arthritis. Crohns. AS. Chiari Malformation & Right Brain venous anomoly. Partial complex seizures. Emphysema. Rheumatic Lung & Heart. MVP and Tricuspid prolapse. Had Lymes disease for 10 years.
Meds: Humira 40mg Q 4 days; Prednisone 20mg; Pentasa 4G daily; Imuran 50mg; Dilaudid 4mg; Diazepam 5mg; Avinza 60mg; Reglan; Antivert 25mg tid; LidoDerm; MiraLax & too many others.

hi erin- this was for a school loans by salie mae...i have put in for a loan forgiveness form filled out by my doc, and now in economic hardship forebaance and they are working on it so thay say....the only way you can get out of paying student loans as they are federally funded and backed by the us g-ment is by dying or TPD. since i have ssdi
i figured i would try the TPD route and applied but sallie mae does  not all follow SSA guidelines, they do not have the same creatia as SSA has and once they rule , you can not fight them for appeal for s Loans to be forgiven

missie i am going to email a former client of mine who is on ssdi and i am almost certain had his school loan forgiven i know he used a community lawyer who specialized in disability law.... hope i get a response as to criteria he used? io do know he claimed bankrupcy too, that might be part of it? yalinda

hi yalinda- i am most certain that these federally funded loans by sallie mae can not be forgiven in bankruptcy courts-ever.

they are forgiven 2 ways, 1. you die, 2. you are TPD and apply to them for this ( using their forms) but i hear from the grapevine that they do not like to do this and can take your taxe returns ( i have no substantial income so any taxes they get will be naught) and or can put leins on anything thing you own bacnk accoutns, houses cars, etc.

they can and have the power to collect 10-15% of your ssdi money from the feds if all else fails. i do not work and only made 5700 in money income last year that i declared. so the odds of them taking my taxe money wil be nill as there is none to get.

 

but please find out from your friend who they used which atty helped them, if it was an ssdi atty they may not know about feds funded G-ment loans like sallie mae.

thanks if you can find out any info. i am going to speak to an estate atty tomrrow to see if they can acutally take my paltry ssdi income for  being in delinquency with these loans.

i explained to the lady who i am working with in sallie mae that this was not my fault and the doc who operated on me is being sued by dozens of other people and that i treid to sue her also but the attys will not take my case b/c she has so many peeps suing her that her insuracen will run out. the worst cases ( peeps who are in wheelchairs and died from her take priority over cases like mine who are just in chronic pain from her botched op) so no more moeny left for peeps like me as i am still alive, pretty pathetic situation, and the doc is not working now from what i here and pet everything in her mom 's name to aviod being personally attacked by attys

Hi  Missie,

 I don't know if this is an option, but it's what I did years ago...I put all my student loans on my credit cards and then filed for bankruptcy that way I wasn't really bankrupting my student loans, but I didn't need to worry about paying them.  Good Luck!
