hi yalinda- i am most certain that these federally funded loans by sallie mae can not be forgiven in bankruptcy courts-ever.
they are forgiven 2 ways, 1. you die, 2. you are TPD and apply to them for this ( using their forms) but i hear from the grapevine that they do not like to do this and can take your taxe returns ( i have no substantial income so any taxes they get will be naught) and or can put leins on anything thing you own bacnk accoutns, houses cars, etc.
they can and have the power to collect 10-15% of your ssdi money from the feds if all else fails. i do not work and only made 5700 in money income last year that i declared. so the odds of them taking my taxe money wil be nill as there is none to get.
but please find out from your friend who they used which atty helped them, if it was an ssdi atty they may not know about feds funded G-ment loans like sallie mae.
thanks if you can find out any info. i am going to speak to an estate atty tomrrow to see if they can acutally take my paltry ssdi income for being in delinquency with these loans.
i explained to the lady who i am working with in sallie mae that this was not my fault and the doc who operated on me is being sued by dozens of other people and that i treid to sue her also but the attys will not take my case b/c she has so many peeps suing her that her insuracen will run out. the worst cases ( peeps who are in wheelchairs and died from her take priority over cases like mine who are just in chronic pain from her botched op) so no more moeny left for peeps like me as i am still alive, pretty pathetic situation, and the doc is not working now from what i here and pet everything in her mom 's name to aviod being personally attacked by attys
I don't know if this is an option, but it's what I did years ago...I put all my student loans on my credit cards and then filed for bankruptcy that way I wasn't really bankrupting my student loans, but I didn't need to worry about paying them. Good Luck!
