Hi Everyone, Yep those %^&##@!)(?><><?!!! denied my appeil! I think I hate them! I think I also hate my lawer who couildn't have fought very hard for me! I got home from a nice fishing trip today, very peaseful and easy w/ a new friend. A old Ex Navy Chief who as in for 30 years +. We went out in his boat and since he was moving kinda slow, so did I and it was a really nice easy time. Then I got home to find a letter from SSD. They said even though they understand that I can't do any physical work such as lifting w/ my condition, they feel that I can do other work sich as desk work.
This is after I wrote over tenty pages describing my work and that it was 1/3 heavey lifting and carrying things around and also that I can't sit at a desk very long either! I guess thay can't read!! So now I have to wait for a cout date which can take up to 3 years according to my crappy lawer's assistant!

I called her as soon as I read the letter and she said> "Oh well, it happens all the time" I told her that I knew that but that that fact didn't make the tears streaming down my face slow down at all. At one point I alluded to the fact that they could have done a little better job which she instantly took as an insult and told me that she didn't deserve to be attacked in such a mannor. Attacked??? I said I didn't attack you lady!!! I'm a little upset here if you haven't noticed! You are the one being insensative Missy! I should have fired them way back when even if it did cost me some $$$ at the time!!! They suck!!! Please don't anyone ever use a lawer who advratizes on TV, especially the big national ones!!! I do hate them!!! The longer they stretch it out, the more $$$$$$$$$$$$$$ they get payed! I believe that if I had a good attn. I would have had a good chance at getting it on my second try!

Oh well, it's just water under the bridge now right!

I need to get myself together for our big day Sunday when our dear Dani & Fam's come to visit!!!

cry  I'm so sorry Pete cry    I wish there was something more to say, but I'm afraid nothing will make it better until you are granted.
 
I'm waiting on my appeal and honestly expect pretty much the same thing, but it won't make it any easier.  I didn't hire a lawyer yet and I will take your info to heart....no TV lawyers!! 
 
I'm sorry it came at such an unpleasant time too.  I hope your visit with Dani will help give you a well deserved boost of encouragement and some added support.

Hi Pete,

I'm so sorry to hear that your appeal was denied, but please don't give up yet! From what I hear a lot of people get denied the first time around, but then get approved the second time. My father (a general practitioner) tells his patients (no matter the disability) to actually expect to be denied the first time -- apparently that's just how it works most of the time.

I'm sure this doesn't make you feel much better right now, but I just want you to know that it's not over yet! Keep fighting!

Sorry to hearabout the denial Pete, it sure sounds awful having to expect to be denied. How many times can you appeal? Is there some sort of process to the appeals?

It must be a nightmare. I can't imagine having to deal with all that bureaucracy on top of all your pain and these incompetant lawyers don't sound good either.

Chin up and just keep on trying, it sounds as if you have to just keep on perservering to get there in the end. I hope so anyway, enjoy Dani and family, golitho

I understand that your disappointed and upset, but to be honest your lawyer is right it does happen allot! My lawyers was hired by my Disability insurance company, and believe me they don't hire dummies, they hire the best because what ever SS pays me they don't have to. Any my appeal was turned and we went to court and it was also turned down, I asked if this was the end and my Lawyer said no, because it was my age and my training in my back ground that was the reason it was rejected, anyway there was something had changed in my case, but I can't remember how it went but we started all over again and again it was rejected and so was the appeal and we went to court and their it was approved after I had some further test done that was ordered by the judge, and when approved it was back dated. It took along time for me, and yes it was very frustrating! The hospital I worked at would not let me work at doing any thin because of my condition! I was extremely fortunate that I had taken out long and short term disability, when I started work there they stronglly incouraged all their employees to take that insurance, and really it wasn't very much less than 5 dollars each pay check. I am glad I took it! Because if it wasn't for the Lawyers they had hired to represent me for SSD I probably would have given up. Plus I had there disability payments which really helped. Anyway Hang in there, your Lawyer just might not be as bad as you might think, I don't know maybe she is, but just the same I think she is right when she told you "it happens all the time" I honestly believe that!

Pete, I am sorry to hear this but I am not surprised. This does happen all the time with SS and believe it or not having an atty does not make it any different. I know many people think because they hire an atty it will change things automatically, but thats just not so. The lawyer has no way of stringing things along to make more money either, SS controls what happens, when it happens and where it happens. The atty cannot be paid anymore money than what SSD approves him being paid if a Contingency contract is signed too. When going before an ALJ for a hearing it is always best to have legal representation, this is why folks hire them. When you are calmer please re-read WhiteBeards post to you. I am not surprised  that it can take up to three years to get a hearing in Florida because of the age factor of the people in that state. Many states it takes that long to get a hearing and its because of backlog of cases waiting to be heard that was filed before yours. Attys have no control over when a hearing can be scheduled either. Its another step up the ladder to get the hearing set up. All you can do is hang in there the best you can.
 
Careful how you manage yourself speaking to your attys office, you don't want to shoot yourself in the foot.
 

crohns disease dx 2002 & small bowel resection, still looking for remission whatever that is, chronic pain 22 yrs, added ulcerative colitis 6-05 to the mix, high blood pressure 28 yrs, aortic heart valve insuffiency, depression, osteoarthritis, osteoporosis lumbar spine, scoliosis lumbar spine, peripheral neuropathy hands & feet, COPD & on oxygen therapy, lupus & psoriasis and psoratic arthritis. Several other health issues just not enough room to list it all. Too many surgeries to list and too many medications to list. Currently on 17 different daily medications. Intrathecal pain pump implanted June 05.

Thanks everyone for your kind words. Yes I am a little calmer now. Skeye, this was my second rejection, not my first. W/B. & S.D. there were things that the lawer should have done and other things I asked for from them and didn't get. I felt left out of the battle. I truely believe had I known what the docs SS made me see said about me I would have had a better idea what I should have done. I asked for those reports but didn't get them. There were other things to but I don't feel like writing them down. One thing I'll say is the girl handling me must have been so overworked that she needed me to giver her my SS# every time I talked to her so she could pull my file just to see who I was>> She didn't even remember me by name!!!!!!!
Anyway, I guess I'm in it for the long hall.

I am so sorry that they denied you again! I truly believe they do this hoping that people will give up. Please do your best to hang in there. It will all be worth it in the end, but for now I know it stinks!

Pete, I can imagine how devastated you were when you read the letter and I can certainly understand your frustration. I do hope that something changes for you and soon, but I mostly just wanted to say that I'm sorry this has happened, and I'm glad you were able to come here and share your upset with us here.

Hang in there and have faith...something will hopefully change for the better and I'll be keeping you in my prayers until it does.

Pete, sorry to hear about the denial on your appeal. I know how you feel, I cried when I got my first denial even though I was expecting it after reading the statistics for denial rates. Now get set to complete the paperwork for an SLJ hearing. I haven't gotten to that step yet so not sure what all is involved but I'm sure there is some kind of deadline for submitting. Not sure where these SS people come up with their decisions. My last denial said I could do my prior job as home health aide even after they stated that I had severe back issues and the occupational handbook that SS supposedly uses for job descriptions states that you need a strong back for this job. Duh!!!!!

I haven't heard anything new with my appeal. My lawyer did send a RFC form (tells how much you can bend, stoop and so on) to my PM doctor. I asked my physicians assistant that I always see for pain management about it and she stated that she doesn't fill out any forms that someone that I've never seen does them. I called my lawyer after I got home and they said that they had received it and that it must have been to my advantage or they wouldn't have forwarded it to SS. I did request they send me a copy but I haven't received it yet. I'm just curious to see what was actually written so I can correct items I think need corrected before SS makes a decision.

I wish you luck and about all you can do at this point is keep on trying. From what I understand 90% get approved at the SLJ level.

Thanks so much for all the support and compassionet words! Well like the lawer lady said, there's nothing I can do about it now but wait and wait and wait for my hearing. No maybe not! Maybe I can see some more drs about my problems? Get more proof? Maybe see a shrink and prove to them that I'm not only physically unable to work but also that I'm crazy! After all who can turn from Mr. super silly man to Mr. depressed popo man faster than me?? I think they used to call this condition manic depressive but now call it bypolar. The problem is so many people think they are bypolar I think this condition is over diognosed and SSD probably knows that and think you can work w/ it! > the jerks!
I think I'll go eat some oatmeal have some OJ and take my meds. Thanks again for all your support! What would I do w/o Y'all???

Hey Pete, wow that really stinks! I am very sorry to hear that you are having to go through this on top of everything else! I am just getting ready to file and realize what a nightmare it is going to be. Not something I am looking forward too but I don't have much of a choice at this point. I hope you can get some much needed good news soon, you will be in my thoughts. Take care and tell Dani Hi and we miss her.

Hi Pete, sorry for this bad news. My first application I filed in July 2006, five months later, recieved first denial.  I filed an appeal at my local office, second denial recieved within 6-9months in 2007.  Hired an attorney, I live in a small high desert town, I did hire an attorney from T.V., he sent appeal.  In September 2008, had an ALJ hearing, at my hearing the judge said if I worked I would need to take my breaks in my car, theie medical Dr. stated I would miss 3-5 days of work a month due to my severe illness, Vocational expert found Two jobs I could do-one working in a hospital in pharmacy doing somthing-can't remember the name, other job had no DOT code(whatever they called it), she also agreed that my attendance would affect the jobs.
 
Four months later or so recieved Denial letter in 2009.  Judge stated my allleged symptoms the way I described how it affected me were not credible,but my illness was severe,that I could do Light sedentary work and theat I would miss 2-3days of work a month,that I was capable of going to postoffice by myself, also that I had chosen this way of Lifestyle and if I won it would benefit my husband (he was working and still is, my hubby had one arm amputated due to accident) aagh!this really hurt me.
 
I was ready to give up, attorney told me to file new application,they had already filed an appeal. few moths later Appeals council didn't think it warranted a review and denied again. Lawyer again said file new application, I did. Denied 3 months later.  Lawyer appealed all the way to Federal Level. In Nov 2009, Federal remanded saying judge needed to look at it again.
Jan 2010,Recieved ltr from same ALJ, saying new hearing will be soon, four months later, got an OTR (on the record dec, "Fully Favorable" all the way back to July 2006, among other things.ltr stated I needed to take my breaks in my car,would miss 3-5 days of work(25%), etc
Don't give up, do a new RFC form from specialist, explain how your meds affect you,get necessary test to prove.
Please dont give up, I almost did! But I know that I wasn't getting any better.

Sorry I'm late in responding... I've had a couple of bad days myself... but I'm so sorry for the disappointing news re: your appeal, how the girl @ your lawyer's office treated you and all that stuff. Really. cry

When filing for SSD it is nothing but a paper war. Meaning obtaining medical records and forwarding copies to SS so that they have all the current medical records. Attys are not allowed to call SS and ask questions about the claim, they are not allowed to call and speak to the ALJ prior to a hearing. In other words the attys has no control, SS totally controls the entire thing. SS office tells the atty not to call unless its an emergency because of the work it takes to find a claimant's file and the volumes of paperwork. It is truly a don't call us, we will call you with SS. One week before the hearing is scheduled attys are allowed to go to the SS office and look at their file to make sure they have all of the current medical records in their file. People have no idea how cut and dried it is with SS. One of the worst things that ever came into effect, was when SS started allowing VE's (Vocational Expert) to sit in on the hearing. That person kills more claims than anyone can imagine, they always say there is a job out there that can be done.

Certainly seeking treatment for mental health issues can benefit you, but may or may not prove disability. Many people with bipolar and other mental illnesses do work, and are fully productive once they have the right treatment and follow through with recommended medications, etc. It might show that there's more going on that you have to deal with and in that way help your SSD claim, but straydog's the expert on that.

      I am so sad to hear they did this too you. I am floored you were denied AGAIN. I say floored because, really.... You just cannot work. Its a sad fact, but true. There is no way for you to be able to work consistantly anymore. To even attempt to do so at this point would cause tremendous harm and damage to your body.
 
      Though I know you are frustraited with the attorney... I doubt there was little more they could do. Let them know you will do what ever it takes to begin the next appeal. Above all,  Keep fighting! Please stay strong. You can do this! You just have to make sure you get their attention and dont give up! I know you feel defeated, and quite frankly who could blame you? But keep at it, don't let them win this fight! They will eventually have no choice but to see the truth. Hopefully sooner, rather than later. Surley at this point the financial strain must be tremendous.
 
      Gosh, I am so sorry they did this to you. It isnt right.

Miss Dani, what are you doing up at 12:45am? You need to be resting up to keep up w/ those wild little Bumble Bees! Thanks again everyone for all the support and help dealing w/ this major disapointment! I know I should have expected it. I also realize I shouldn't be putting so much blame on the lawers but I still just feel like there must have been something more we could have done! Something we missed I mean how could they not see the obvious? Why torment people like me? Over the years I've met so many people who recieved SSD who were not near as deserving as me, some on the first and second try! Thats why I feel this way. But thats how it goes in Peteworld, thats how it's always been! I always get the popo end of the stick! I don't know why I exspect anything different!!!!! Sorry to sound like a whiny crybaby but some things just aint right and this is one of them! Yes, I believe I will finally win this thing, I'm not going to give up and I think they know that too so why drag it on like this? job security for all the red tapers I guess.
I hope every one has a great low pain day today! Dani, if you read this, I'll call you this afternoon to make plans for tomorrow>> I'm so excited!!! I'm like a kid on Christmas Eve!!! We're gonna have soooo much fun and forget about all our troubles!!!

    That is exactly why I am confused about it all. You must have read my mind. I have met soooooo many people quite frankly using the SSD system for all its worth. I even met a guy who was collecting because his knee, yett still worked for cash under the table in landscaping business. When I asked why,"I don't get enough from SS, and this way my SS isnt taken away."  Crazyness I tell you. Also, you have worked non stop since you were a teenager. Its obvious you have spent your enitre life working. WHY deny your claim?!?!?!...have about a thousand questions..and the answers all come back as four letter words & bewilderment. 
 
   Hehe I was up putting decorations up for the girls birthday! Miss tess is june 3rd, my mother-in-law is june 5th and my little rosie is june 7th! So, needless to say the entire population of Florida & Georgia will be there today! It took forever to decorate the enclosed patio / pool room with hanging butterflies, bumblebees and lady bugs! Once I got up all the ribbon I had to go inside and do the formal dinning room and kitchen! There are lady bugs everywhere! Even little pin-the-tail on the lady buggs!
 
    The cooking stuff was all done by my mother in law, thankgoodness! I was pooped and exhausted by 9pm! But I had to get all the treat bags (fairy wands, fairy kites, kelidoscopes, bubbles, crowns, light up pool balls, sunglasses, yoyo s, pop-up ladybugs, water guns, whistles and sticky alien hands), candy centereices, streamers, shredded glitter and confetti done! When I got back to the hotel I was sure my body was on strike! I had thought at the time, well.. Ill just do the outside once the sun goes down..... I WAS EXHAUSTED, it was like a sauna out there still! And worse, you know I think there are even MORE buggs at night! I have enough bug bites to do a dot-to-dot on my leggs smhair   My body is not liking the combination of increased activity, new meds and heat! I have spent three days on the verge of vomiting. Yuck!
 
     All that is left is a BUNCH of pool toys for the kidds, balloons & Ice.... I think. I hope so anyway if I forget something at this point I might just cry. My body isnt liking me right now, not one bit!
 
    Yes! Do call! I will keep the cell phone on me or david and hopefully I will hear it ring! I have to go get ready for the bumblebee brigade! Hope to hear from you later!

Pete my buddy, how dare they give you a bad time. Let mr know if you want me to call them and get their act together. You will love this one. As I am applying for unemployment I have been asked what jobs I am qualified for and which ones I am applying for. There is an opening here for someone to do SS Disability evaluations. I am not sure they would hire me if they find out I can write the word yes as well as no. I looked intently at the qualifications and it did not say "ability to write no repetitively" but I am sure that is part of the job. Keep pressing forward and don't give up the fight. I am sorry about your denial. Hang in there and don't be too discouraged. It will come when it comes. This is just another trial of patience, my friend, but I feel certain you will get your disability. How long have you been unemployed now? Not a year yet has it?

Well, my friend, I am praying for you and for you to remain calm and at peace while this process unfolds. Never give up!!! You are so special.

I was lucky enough to receive my answer last week as we had put a rush on it and my answer was YES I qualify for permanent disability. It takes a bit of stress off

 Chronic, severe and continuous bilateral temporal headaches since April 2000.
 Poor prognosis, seen thousands of doctors, been on dozens of meds and tried all forms of treatment with no success.
   May 2010 to present taking DM, dextromethorphan, 4x/day, to continue to reset the receptors, weaning off of oxycodone as it did not help with my pain, pain continues to be terrible every minute of every day!
  Feb to end of April 2010:3 cycles of IV Ketamine infusion via a PICC line and pump at home, this was to try to break the pain cycle by resetting the receptors
 Meds: oxycodone for breakthrough, cymbalta, vitamin D, B12, magnesium, omega 3, melatonin
 Profession: Part time registered nurse on Long term disability and applying for permanent disability thru CPP
 52 yrs old, female, married, two boys 19 & 21, live in Ottawa, Ontario, Canada

Suzane, I'm so happy you recieved your disabillity> Congrads! Maybe it's a little different in Canada? Without getting too political I'll just say> I doubt they are any different! polititions are all the same no matter where they are from! most are ego maniacs or they wouldn't want the job in the first place! Since they make the laws> I'll stop before I really get going!! But thats wonderful for you!!!

FJ, I think you should aply for the job!! Unfortunately for all of us, they would never hire someone like you! Your compassion would put you way over the top on there quallifications, I'm sure of that!!! Thanks for giving me a good laugh though!
Dani, I'll bet it was an awsome party! If it was half as good as your visit w/ us it would be a huge success!

When I was young & stupid I broke almost every bone in my body and I'm paying a heavy price now but I'm still here and so glad to see my two sons grow up to be fine young men, both are in the Navy. I'm so proud!
