News on SS disability case!

Okay this is really least to me it is.  I recieved a letter today from SSA regarding my case.  After the Judge advocate denied my claim my attorney set us up for an appeal, which was sent off to  Falls Church VA.  At that hearing I did not have to be there.  Okay so the letter states that the Appeals Counsel sent my case back down to the Administrative Law Judge (Judge Advocate I believe) for review again.  The main page says Remanding case to Administrative Law Judge.  Now.....The on thing that always bothered me was that the Judge Advocate said that I had residual functional capacity to perforn the full range of sendentary work, but only gave me ONE job that I supposedly perfrom.  He also did not even look at the third party function report that my husband filled out and did not even ask him any questions, though he sat in the entire hearing with me.
The Appeals Counsel said something about this that they HAD to take into consideration his report when deciding their decision.  Plus it would seem, from what I am reading that I get to go back to another hearing UG!!!!
Now....what all this means......No idea.  But, I'm really in no shape to sit through another danged 1 hour session where they get to decide my fate!!
Just needed to vent.

Oh wow Scarred, I think that's really good on one end and really difficult on the other! Vent away! I think we all need that. I'm dealing with SS as well after being on Disability for the last almost 10 years! They are "reviewing" my case and I am doing so much work it's crazy just to be able to hang on to mine. Just keep fighting and frankly, I'm really glad you have an attorney because the paperwork can be so overwhelming on your own. Please keep us informed and as for me, I would like to give you my support at any time. Take care!

DXed-Syringomyelia C-1 to T-1, Hypothyroidism, Diabetes Type II, IBS, Panic Disorder, ICC , Fibromyalgia, Migraines, Bipolar Disorder, Chronic Muscle Spasms, Torn Rotator Cuff in Left Shoulder, Had emergency surgery for ruptured bowel in '05 w/colostomy and takedown in '06.
Too many meds to name/Too many allergic reactions/sensitivities to too many drugs to name. Meds for Panic Disorder, Pain, Bipolar, IBS, Hypothroidism, Diabetes, Insomnia and then some.

What does your Attorney say about this? It does sound like you might have another hearing, and don't be surprised that they might want more test done or some other type of documentation, ( that is just a guess on my part but I would not put it past them!) I know what a hassle it is to go through, I went thru two different hearing, with two different judges, at two different locations! Hang in there! I know it is confusing and frustrating and .......well..... it is just no fun at all! It is bad enough when you don't feel good and your in pain and then you have worry about all this stuff too!

I so wish it didn't have to be like this for so many of us. But I am glad you have an attorney and hope that he/she is in there fighting for you!

On a strangely positive note, something like a total turn around and return to the judge may not be a bad thing at all. Often times legal people are given the opportunity to "re-examine" information for errors before reconsideration of a questionable finding. This can result is satisfactory results for all involved and no additional internal investigations. Who knows.....this may be the break you were looking for.

Scarred, I'm in the middle of my first appeal after receiving my denial on the first round.  I can't really give you any advice regarding the letter you received but am keeping my fingers crossed for you.

DDD, osteoarthritis, facet syndrome, fusion surgeries C-5/7 & L-4/5 both in 2006, torn meniscus surgeries left knee 2000 & 2002, buldging disc L-2/3

Thanks everyone. I did put in a call to my attorney but he hasn't gotten back to me yet. I had hubby read it and he says that since the judge advocate didn't include his report as well as the fact that the hearing recording was not therre, that the judge advocate has been told to review all of the information and issue a new decision.

This just might be the news I was waiting for, but here is the thing. If I have to make the long 14 hour journey clear to Cody to see that judge again....I'm not going to walk away without a finaly decision!

Hi Scarred,

Sorry to hear that things aren't going well for you. Sometimes I wish that someone else could live a day in our shoes & then they wouldn't be able to judge us so easily. I hope your attorney has some good suggestions for you & can get this mess sorted out. I'm saying a prayer for you!
