Well Hello Friends, Fams and new Peeps I duno yet! Yes indeedy, I had my SSD hearing yesterday in front of a Jumbo TV set in an Official SS office w/ my nogoodforcrap appointed lawyer (who didn't call me till the day before to go over what to expect!) sitting next to me w/ a file at least 6" thick! The Judge seemed like a nice guy as he chatted w/ my legal shyster dude about all the cases they had scheduled that day together!!
After the court recorder Lady opened and the Judge swore me in they exchanged some legal jargon I didn't really understand, we got underway.
Both the Judge and my Shysteroo asked me questions, mostly about how my health affected my everyday life at first to which I told them that I still do most things like gardening, housework and cooking but that I now had to stop quite frequently because of back, neck and hand pain mostly. They also asked about the different treatments I have tried over the years including> P- theropy, injections, drugs and surgery. I was pretty nervous to say the least w/ so much at stake and the fact that I was sworn in to tell the truth> the whole truth and nothing but the dadgum truth. I mean I couldn't lie about anything which I didn't! I didn't have to because after the Judge heard that I gave up a job I loved making a bunch of $$$ and that my boss didn't want me to leave, it was obvious to him that I had a legit claim and that I was in a lot of pain!!!
So after bringing up only about half of my health problems, the Judge said> "I've heard enough and Mr. Pete's trip's judgement is "Favorable!!!"  
I asked my shyster if that meant I won and he said> "Most definitely!!!"
Then the Judge said I would receive my letter and paperwork in 3~4 weeks. The shysterdude then reminded me of my fee agreement and that I should get my bank account # to their office so that they could dirrect deposit my $$$ instead of sending a check which would take much longer!
So thats kinda what happened, so if any of Y'all have some questions for me about it, please let me know! I know I haven't been around in some time but I just got back from a two week trip taking my Snowgoose Mom up north for the summer and have been crazy busy for the past couple months!!! Also my hands are dead! More than they ever were before and after writing letters to my boys practically daily who are both on deployment in the Navy my hands are pretty much shot!! I will be watching this thread though just incase I can help out a Fam member w/ their SSD Stress!!! I feel your pain and I know how much it sucks waiting!!!

What great news to read Pete!! I am so happy you had a great judge who really took time to care about you as a person, not just another court number.

I hope that this win helps you in as many ways as possible - financially, mentally (no more stressing about it!) and physically too. I hope you are able to get some help for your hands....with all the typing you've been doing, they must really be in pain. Have you ever had a paraffin wax treatment on your hands? It might help - you could ask your physiotherapist about it.

Anyways, congratulations on winning and I hope things start turning around for you in a positive way! :-)

Hi Pete!!

Congrats on the WIN!!! It is great to know that another of our members has won and managed the Social Security Disability ins and outs!

I also won my case on Monday May 9th! I actually had a judge fly to Ohio from California to do in person hearings! I was not sworn in, but I did realize that I had to tell the truth. The judge was the only person that asked me any questions.

In the room was the Judge, the recorder, the Vocational Expert, myself and my lawyer. BTW, my lawyer was part of legal aide of western ohio, so I did not have to pay him a dime! My folder was over 400 pages long and was not on CD, it is all a paper file (which according to my lawyer is unusual for the ssd system).

The judge read my previous decisions in to the record at the beginning of the hearing. Then he started asking me questions. It felt like it took absolutely forever!! BUT, in reality from beginning to the end my hearing lasted an hour. After the judge asked me questions, he asked the vocational expert questions, then he awarded me my full disability. I was shocked!! I never thought I would find out the same day!

Just popping in to say Woohoo lovie I am so made up for you, such a weight off your shoulders now. So nice to hear good fantastic news.

Disc degenerative disease, L3/4 board disc bulge, L4/5 board disc bulge with significant nerve root compression on right L5 nerve root and also DDD at L5/S1. I also have an enlarged uterus with fibroids and have been a sufferer of psoriasis now for about 8 years.

Good news. Glad you finally got what you deserve.
2 confirmed herniated lumbar discs. Spinal Arthritis. Spinal Stenosis, diabetic peripheral nueropathy.

Wow, Pete way to go...I'm so glad it worked out for you....
So whens the next fishing trip? and how soon will your boys be home???
Jazzie is home for the summer from University, we have a short weekend trip to
San Antonio planned for June 10th...anyways will look forward to hearing more from you now...

Yeahhhhh Pete!  I'm soooo happy for you!
Please take into account that you will have to pay taxes on the back payment lump sum!  I didn't realize that it was quite so high.  Don't get me wrong....I'm not complaining.....absolutly not!   I just wanted to let you know so that you can get the info to your accountant.  It's worth the time and trouble to do it right.  Also, SS has a place on their site that links you to a voluntary withholding of your tax responsibility.  Thank GOD I shouldn't be so upside down next year, but this was a dooozy!

Thanks sooooo much for all your chears & support!! Sorry I haven't answered quicker! R-T, yes I know about my tax obligations to Uncle Sam, my older brother warned me long ago. I'm just happy I finally won, just wish I never hired the worthless lawer I did! I'll tell the whole story on that someday but not today!

Congratulations Pete! I know that you were really hoping that this time would be the charm and it sounds like you had a wonderful judge to hear your case. I'm glad that it worked out in your favor. I hope that you get your payment soon and then can breathe a sigh of relief .

HIV+. meds - epzicom, Kaletra . oxycontin as needed , Hip replacement has been a total sucess , I feel blessed and thankful and happy most of the time . Everyone in the CP Forum shares in my sucess , thank you all !!

Thanks Mikey!!! Yea>Buddy, You ain't lyin about some of us deservin some help when you really can't work anymore after paying into SS for soooooooo many years! I couldn't believe the Judge, it was like "why are we evan here" This is crazy that you have so many things documented that are wrong w/ you and 5 dr's that say that you can't work anymore! HE DIDN'T EXACTLY SAY THIS BUT IT WAS SO EASY TO SEE WHAT HE WAS THINKING BY THE WAY HE TALKED AND ACTED! Woops, hit the cap locks! Anyway, thanks again Mikey, it means a lot hearing it from an old friend who has been w/ be through the whole battle!

Congrats Pete....I am hoping that I will have the same great news soon.... Although I only applied in January and have been to "their"doctors already... I remember the good old days....a few months ago..I would go to the mailbox and actually get happy when I saw an envelope from SS Admin. Now I'm lucky if I get anything... My DDS worker just tells me that the Dr. is now looking over my records and the other Dr. findings...and that is the longest part of the process..... Oh WOW!!! I know it hasn't been that long but I am still on pins and needles....waiting....waiting.....waiting....

I also applied for SSI.... any help would be helpful Pete.. LOL

Rhonda, I wish you luck w/ the whole SSD prosses! I wish I could say you'll get it right away> Some do and I really hope your one of them! As for me, I was low balled by the lawyer I picked who had every intention of leading me on and telling me what I wanted to hear to shut me up knowing all the while that they were not helping me at all till it was time to see the Judge! They didn't want me to win till then so they could build up a bigger cut of my back dated check!
They didn't evan get my pain dr's files on me till the week before my hearing! I thought they had them 2 years ago and was totally shocked when the week before my hearing they told me to call my old pain doc of 8years and give them my credit card # so they would send them my files!!! She (my old pain doc) was my biggest backer of getting SSD and social security didn't see her reports till a couple days before my hearing! It makes me sick that I have to pay these shysters!!! They totally lied to me and screwed me over big time! Oh well> Live and learn! Getting all upset about it now is only going to make me sicker so I should just try to forgetaboutit!!!
Please try to make sure you get all your paperwork to SS so you don't end up waiting 2 years like I did!

Congradulations, Please remember along with SSD, or SSI comes Medicare.  Please get yourself a book from your locat SSS office and start reading, paying close attention to pharmacy benefits.  Good job, and Good luck
Hope you are having low pain, sometimes even if temporary the joy at getting what you deserve makes you feel better, even for a little while.
degenerative disc disease, fibromyalgia, osteoarthritis, neuropathy, lumbar laminectomy july 1998 no help, rechargeable neurostimulator unit low right back w/lead wires to left side and right leg unit not working just sitting there.i am 57 years young in may will turn 58. i have 2 grown daughters, 25 and 29. i have 2 grandchildren, 9 year old grandaughter and 5 yr. old grandson

C2 to T1 decompression and instrumented fusion. Specifically, laminectomy at C2 to T1 with right foraminotomy C2 to C7 and left C5 to C7 with arthrodeisis C3 to C5 with structural rib allograft and local vertebral autograph, and at C7 with the same structural rib allograft and local vertebral autograft, and Vertex instrumentation C3 to C5

Congratulations on winning your case. I'm a disability attorney with some chronic health issues and just wanted to say that I'm sorry you had a bad experience with your attorney and that we're not all cut from the same cloth! I will say, though, some of the things you are describing are pretty standard in the practice... Best of luck to you.

Hey!..."Welcome" to the Chronic Pain forum! I see that you have been spending time on the "Fibro" forum, and wanted to extend you an offer to join us here as well. As a "Disability" attorney, you would be most welcome here, as many of our members have questions about these types of issues.

If I sound kinda of selfish for our members, I am! This issue has been one of the most disheartening actions to go through for many of our members, so if you have any advice to offer, we certainly would appreciate it.

I think you would be better served and warmly welcomed if you would please start a new topic and tell us a little about yourself. You will receive quite a bit more exposure this way, and we certainly want our members to meet you.

Many of our members suffer from "Fibro" and many other debilitating conditions, but the main thing is that we all suffer pain chronically in some shape of form. This forum, understands what suffering with chronic pain is all about, and the members have a deep understanding what it is like to live with it. I believe, with others, that this is one of the best forum's for chronic pain support, and we are thrilled you have found us, although we are sincerely sorry for the reason as to why.

Feel free to visit anytime, and ask all the questions you wish. While we are not Dr's, we can, and do freely share our personal experiences, and can often point a person in a better direction.
