Workes comp is a joke

Ive been waiting 10 years to get my back fixed other than mild to sever pain i was able to do daily activities. last night i was using the computer and went to stand up and realized im paralized from the waste down. So now i begin another adventure in my life is there grounds to file suit on wc for dragging thier feet and delaying my care? I feel they are directly responsible for the delay in my care.

             Sorry to hear of your health issues, and the problems that sometimes come with WC. shakehead
 
     In many cases it may be best, and needed, to seek councel and or the services of an Attorney. I would suggest you start there for starters. Also make sure yoou keep good records and copie of all your paper work, as you may well need it for the long run.
 
     Many Attorney's will offer a free consultation, just make sure you ask about it first.
 
     The laws are different from state to state regarding the responsibility of your employer and what your rights may be, so again, seeking Legal counsel might be the best corse of action.

Hi Painsick, SE gave you some great info about consulting with an atty in this matter. When looking for an atty I suggest that you find one that handles nothing but worker's comp cases too. As SE said each state is different in what their requirement are and what kind of limitations are in place to file a claim. I would imagine you will need medical evidence that supports this is related to an injury at work and the only way of proving that is by what your dr is willing to say. I hope that you will be seeing a dr real soon.

Went to see doc this morning he is sending me to an ortho they are saying surgery before Christmas to salvage what use i may have left of my legs. Yah my doctor has been frustrated for a long time trying to get me taken care of just for wc to deny or delay my care. i now have medicare and cannot wait any longer my time has run out. So i authorized my doctor to go ahead and use my medicare to get the ball rolling. he prescribed a wheelchair and a walker to help get me by until we can get to surgery

Hi painsick~

I'm so sorry that your mobility has become so limited. It's another blow you surely didn't need. And this time of year just makes it feel that much worse. I hope they can stop or even reverse some of the damage caused by the delay. Often what the state's labor services do is shameful. But from my point of view it's usually the rules and regulations put in place that is the problem, not the individual people whom you are dealing with...usually. My hubby works for our state's Labor & Industries department but he doesn't have anything to do with claims. He is a computer programmer and keeps some of the system up and running. But, some of the stories he comes home with can bring you to tears. I too just don't get it. The state is so set on taking care of the citizen and education yet those budget items are the last to get funded.

OK, I'll get off of my soap box but I do think that the advice above is solid. Keep us posted and good luck.

Hi Pain I'm so sorry that WC has drug their butt so long that you're in this position now. I wish you good luck with surgery and keeping your legs working. You take care. Keep us posted on your condition, etc.

Dx: osteoarthritis, bursitis in left hip, Osteoarthrits in right hip, compression fracture in thoracic spine due to falling on frozen ground March 2001 , ddd, spinal stenosis, bone spurs, osteoarthritis in spine, osteoarthritis in both knees
Meds: Fentanyl patch, oxycodone, otc: BenGay, Tylenol Arthritis on occasion

I too know the delay of w/c from getting my meds and much needed surgery. I have had a lawyer for a year and that has helped me

crushed lower knee and vertical fx of tibia/external fixator placed/plates and screws and tried to place big pieces of cartiledge under knee cap/tremendous pain in affected leg continously without improving/allergic to metal in left leg/leg isnt straight/ metal removed in July//then total knee replacement/straighten out leg/more phsyxical therapy/take oxycontin,flexeril,cymbalta,vicadin for BT
