Hi

I found out last week that I am going to loose my job due to medical capability. I disclosed my mental health to my employer and I think it was the worst decision I have made and would not do it again. I have felt discriminated against since then and I am now feeling depressed about the whole situation. I am going to appeal and take to a tribunal in needed but I am worried about the future and wether I will be able to find a other job.

Dear Ben,

You have every right to be feeling down.  I know you are worried about the future but for now try to concentrate on your appeal.  You can always put some feelers out or network with friends re what may be a job that would interest you.

You are a really special person and good things will come your way.

Lots of hugs,

Kitt

I agree with Kitt and I do think you were discriminated against, do take it to court. You can find an attorney on a contingent (sp) fee. Meaning they don't collect unless you do. Also you can probably get unemployment for this. Do use all of your options.

Best wishes,

Hugs, Karen

I agree with the others. An employer can not fire you for having a physical or mental disability. Did they give you a letter confirmig that you're being "let go"? Does it say anything about your condition in this letter? Did you ever have anything in writing with HR stating that you have a problem? Were you ever reprimanded? Did you disclose the condition in an email or word of mouth? If it was an email, make sure you save a copy. Definitely speak to a lawyer. You may not be able to get the ball rolling on an wrongful termination suit until after you have left but don't leave prematurely because that would hurt your case. Try not to be down on yourself for opening up to someone, you had no idea this would come of it and the way you are being treated is completely unethical. You're not a bad person because you have challenges.

If you are "let go" you can collect employment so long as you have been employed for over 6 months. Keep your chin up, maybe this is for the best, it sounds like this may be the opportunity you need to make some changes in your life.

I don't expect you to answer all my questions but these are the questions a lawyer will ask. They will ask you to remember dates. Make a timeline of occurances if you can, the date you opened up, the dates you felt discriminated againt, exact comments that have been made and the date you were told your position wasn't secure. I have been through this, that's why I know.

I hope this turns into a positive & you go out and find a career you love.

Hi Notsosickygirl

Thanks for your post. I am currently waiting for the letter to confirm there decision which if they follow the procedure should arrive tomorrow by the latest So I do not know what is in that letter yet. They did say that the reason was related to my mental health. I have never received a letter from HR stating that there was a problem but did raise with them that I was feeling bullied by my employer. I have never been reprimanded or had any sort of disciplinary action against me in-fact it has been the complete opposite and all I have had is positive reviews in regards to my work. I disclosed my mental health by word of mouth.

It is a very high anxiety time for me at the moment and that makes me feel depressed. My employers opinion was that they have done every thing that they can but when I asked for some reasonable adjustments this was not allowed so I think that is were I have been discriminated against. There are more details but do not want to go into them to much on here.

Do write things down, if you do and you date them, it is concidered a legal document. I have been through this too. I think you have a good case. Do talk to an attorney and sign up for unemployment.
