Medical records Release

I am having an issue with my doctor to release my medical records for a upper endoscopy done on 12/06/10. Repeated issues to get this medical information have gone answered by her in the form of phone calls, letters and as of yesterday, i even went back to her office and requested this in person to the lady working in the office. Can a doctor refuse to give written information on the exam she has done??? She had no part in my surgery at all - This was a visit on my part to get answers on major problems after my surgery and the upper endoscopy needed to be done to see if my hital hernia and 270 degree stomach wrap was done right. This has me really upset as she saw something not right and only gave me color pictures of the exam done on that day. No written information. Please advise Thanks bob

I am 99% sure they have to give them to you..I would make a request in writing and keep a copy for yourself and then see what happens they may charge you but they can't refuse...I would google the question for your state and see what answers you come up with !!! You may have to contact a attorney I use prepaid legal and can call them anytime I have questions ....keep us posted I am curious as to what will happen...another thing did you have it done at a hospitial? you can get records from there and they shouldn't give you any grief about it...just may not be everything there that your needing...

Be aware that you may be denied access to some records, usually related to mental health records. If a provider believes that letting you look at your medical records can endanger your physical health, your request may be refused. They cannot deny you access just because they think you will be upset, unless they believe that upset will lead to an attempt to physically harm yourself. If you are refused, the provider must make that clear, in writing.

Usually obtaining a copy of your medical records is not a problem.  Often there is a copy fee charged by the clinic or medical records at the hospital.

LaDawn and kitt Thanks for the information. So far, i have not been able to get access to get these records by any means. Kitt- i understand what you are saying that some records can endanger ones mental health, but this was an upper endoscopy that she did on me and like i said, i have the color pictures of this exam, but nothing in writing. I have no idea at all as to what these pictures mean without the written information that is to go with them. Thanks bob

You should have a written report that lists the findings at the end of the report.
 
I do know a lot of the big hospitals are copying medical record's such as scans, MRIs etc on CDs.
 
I am not sure if they copy the whole medical record to a CD.
